About
These terms govern coaching and consulting services provided by Simon Elliston Ball, trading as a sole trader registered in England. By booking or engaging services, you agree to these terms.
Services
Services include one-to-one coaching sessions, consulting engagements, advisory retainers, and workshops as described on this website and agreed in writing before an engagement begins.
All services are delivered by Simon Elliston Ball personally. This means availability is subject to the constraints of individual delivery, including illness or other circumstances beyond reasonable control.
Booking and Payment
Coaching sessions and consulting engagements are confirmed once booking is accepted and any required payment or deposit has been received. Payment terms will be agreed in writing before work begins.
For ongoing engagements, invoices are issued monthly in arrears unless otherwise agreed. Payment is due within 14 days of the invoice date.
Cancellation and Rescheduling
Cancellation by you
- More than 48 hours' notice: You may cancel or reschedule at no charge.
- Between 24 and 48 hours' notice: The session may be rescheduled once to a mutually convenient time. If rescheduling is not possible, the full session fee applies.
- Less than 24 hours' notice or no-show: The full session fee applies.
Cancellation by me
- I will give as much notice as possible if I need to cancel or reschedule a session.
- Cancelled sessions will be rescheduled at the earliest mutually convenient time at no additional cost.
- If I am unable to deliver a session or engagement due to illness or circumstances beyond my control, no fee will be charged for the missed session.
Illness and exceptional circumstances
Both parties may reschedule without penalty in the event of illness or genuine emergency. I ask for as much notice as you can reasonably give. I will extend the same courtesy.
Ongoing engagements
Coaching partnerships and consulting retainers may be ended by either party with 30 days' written notice. Any sessions already paid for but not yet delivered will be refunded or credited at your choice. Unused sessions within a package expire 12 months from the date of purchase unless otherwise agreed.
Confidentiality
The content of coaching sessions and consulting engagements is confidential. I will not share details of our work with third parties without your explicit consent. I may reference general themes or anonymised examples in my writing or speaking, but never in a way that identifies you or your organisation without permission.
Limitation of Liability
Coaching and consulting services provide guidance, frameworks, and perspective based on professional experience. They do not constitute legal, financial, or therapeutic advice.
Decisions and actions taken as a result of coaching or consulting are your responsibility. My liability for any claim arising from services provided is limited to the fees paid for the specific engagement in question.
Intellectual Property
Any frameworks, templates, or materials I provide during an engagement are for your use in connection with the engagement. They remain my intellectual property unless explicitly agreed otherwise in writing.
Work product created specifically for you during a consulting engagement belongs to you, unless otherwise agreed.
Changes to These Terms
I may update these terms from time to time. Changes will be posted on this page with an updated date. Existing engagements will continue under the terms agreed at the start of that engagement.
Governing Law
These terms are governed by the laws of England and Wales.
